1. Service and Provider

Kaiku ("Service", kaiku.live and the Kaiku iOS/Android mobile apps) is an AI-assisted personal wellness mentor supporting balance of body, mind, nutrition and relationships. The Service is provided by Tomi Ansamaa, Mannerheimintie 12 A, 00100 Helsinki, Finland, tomi.ansamaa@gmail.com ("Provider", "we"). By using the Service you accept these terms and agree to comply with them. If you do not agree, do not use the Service. Together with the Privacy Policy, these terms form a binding agreement between you and the Provider.
2. Not a Medical Service — Disclaimers
**Kaiku is a wellness application: couple guidance, self-reflection, and a wellness companion.** It is not a medical device, and it is not psychotherapy, therapy, or a doctor or psychologist visit. The Service does not diagnose, treat or prevent any disease. The AI assistant is a reflection tool — not a therapist, psychologist, psychiatrist, doctor, physiotherapist, dietitian, lawyer or financial advisor. Use your own judgement, especially for medical, legal or safety-critical decisions — AI suggests, you decide. Kaiku provides crisis detection and routing to emergency resources (the app shows locale-appropriate numbers such as 112 in the EU, 911 / 988 in the US, etc.); in an acute crisis contact your local emergency number or crisis line immediately. Product-specific disclaimers (workouts, nutrition, mental health, couple mode, medication) are shown in-context within the app where the relevant feature is used.
3. Account, Age and Responsibility
Using the Service requires creating an account. You are responsible for your account security, your password (if applicable), and all activity through your account. **Age limit:** You must be at least **16 years old** to use the Service. **Couple Mode and social features are for adults (18+) only.** We verify age at registration. If we become aware of accounts below the age limit, we will close them. Notify team@kaiku.live immediately if you suspect unauthorised use of your account.
4. Subscriptions, Pricing and Right of Withdrawal
Kaiku offers a free tier and paid subscriptions (e.g. Premium, Pro). Subscriptions are billed monthly or annually through your chosen channel: **Stripe** (web), **Apple In-App Purchase** (iOS), **Google Play Billing** (Android). Applicable terms, prices and VAT are shown before purchase. **Auto-renewal:** Subscriptions renew automatically unless you cancel at least 24 hours before the end of the period. You may cancel at any time: web subscriptions from your account or the Stripe customer portal, iOS via Settings → Apple ID → Subscriptions, Android via Google Play → Subscriptions. Access to paid content continues until the end of the current period. **14-day right of withdrawal (EU Consumer Rights Directive 2011/83/EU):** Consumers have the right to cancel a subscription within 14 days of purchase without providing any reason and receive a full refund. Refunds are paid within 14 days of receiving the cancellation request. This right applies to consumer purchases in the EU/EEA. Refund requests: team@kaiku.live (Stripe) or via Apple/Google as applicable. **Price increases** will be announced at least 30 days before they take effect; if you do not accept the new price, you can cancel the subscription before the effective date.
5. User Content and Intellectual Property
**You own your content.** You retain all intellectual property rights in the content you create in the Service (chat messages, audio recordings, images, journal entries, shared Moments). You grant us a limited, revocable, worldwide, royalty-free licence to process your content solely for the purpose of providing the Service to you (storage, display to you, processing through AI models to produce a response, display to your partner in the Couple Mode context). **The licence terminates automatically when you delete the content or your account. We do not use your content to train AI models, for advertising, and we do not sell it.** AI-generated responses are, per the AI provider's terms, free for you to use. Anonymised aggregated data (e.g. user-base usage statistics from which no individual can be identified) is the Provider's derivative data for service improvement. **In Couple Mode**, shared content (image, message, answer) is owned by the sharer. The recipient retains viewing rights to shared history even after Couple Mode is dissolved (shared history is not deleted by a normal dissolution). You may use **Emergency Delete Couple Mode** (Settings → Emergency Delete Couple Mode) which immediately removes shared data from both sides without notifying the partner — this is intended specifically for intimate partner violence situations.
6. Prohibited Use
The Service must not be used for: (1) unlawful activity or circumvention of EU/Finnish sanctions (Russia, North Korea, Iran, Cuba — the service is not available in these countries); (2) harassment, threats, hate speech or unlawful surveillance of others (e.g. misuse of Couple Mode in the context of intimate partner violence); (3) distributing harmful, unlawful or copyright-infringing content; (4) circumventing technical security measures, reverse engineering, scraping, automated requests or denial-of-service attacks; (5) manipulating the AI system to produce prohibited, harmful or misleading content; (6) impersonating another person; (7) commercial resale of the Service without a written agreement. We may restrict, suspend or terminate your account for material breaches of these terms. In serious cases we may report to authorities.
7. Use of AI and Your Rights
When using the Service you are interacting with artificial intelligence (EU AI Act 2024/1689 Art. 50 disclosure). AI may sometimes produce inaccurate or incomplete content — use your own judgement, especially for important decisions. You have the right to: (a) know when you are speaking with AI (we disclose this clearly in each AI interaction); (b) request human review of any AI-produced response (team@kaiku.live); (c) decline to use AI suggestions without affecting your access to the Service; (d) know which AI providers we use (Anthropic Claude, OpenAI Whisper/TTS/Realtime, Groq Whisper — see §5 of the Privacy Policy). Kaiku is a reflection tool, not a medical device — the same category as wellness apps such as Headspace, Calm or Woebot. **Upcoming features:** Biometric voice emotion recognition (Hume AI) **is not enabled at launch**; when it is released later (estimated Q4/2026) it will require a separate opt-in consent and an updated privacy policy. Emotion analysis will not be used in workplace or educational contexts, in line with the EU AI Act prohibition.
8. Limitation of Liability
The Service is provided "as is" and "as available" without express or implied warranties. To the maximum extent permitted by applicable law, we are not liable for: (a) the accuracy, suitability, completeness or consequences of AI responses; (b) actions you take based on AI responses; (c) service interruptions, defects or errors; (d) data loss if you have deleted your account or content; (e) the operation of third-party services (e.g. Apple, Google, Stripe, wearable devices). Our total liability for all claims combined is limited to the payments you have made to us in the last 12 months. **This limitation does not apply** to damages that cannot be excluded by law (e.g. damages from intent or gross negligence, personal injury under consumer law, your statutory rights).
9. Changes to These Terms
We may update these terms. Material changes (e.g. new fees, material functionality changes, limitations of liability) will be communicated 30 days in advance within the app, by email and at the next Service launch. By continuing to use the Service after the changes take effect, you accept the updated terms. If you do not accept the changes, you can terminate the Service and receive a refund for any unused portion of your subscription period.
10. Termination
You may stop using the Service and delete your account at any time via Settings → Delete account. Upon account deletion, your personal data is removed within 30 days, except data we are legally required to retain (see Privacy Policy). We may terminate this agreement and close your account: (a) immediately for material breach of these terms; (b) on 30 days' notice if we discontinue the Service; (c) where the breach is not urgent, we will give you 14 days to remedy before closing. You can export your data (Settings → Export my data) before account deletion.
12. Applicable Law and Dispute Resolution
These terms are governed by the laws of Finland, excluding its conflict-of-laws rules. Disputes are first resolved by negotiation. If no negotiated settlement is reached, the dispute is heard in the Helsinki District Court. **Consumers**: you may also bring proceedings before the courts of your place of residence. As an EU consumer, you have the right to free alternative dispute resolution: in Finland, the Consumer Disputes Board (kuluttajariita.fi), and the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr). Mandatory consumer protection provisions of your country of residence remain in force.
